1. Introduction

These Terms of Service ("Terms") govern your use of PicTools.AI and all the AI-powered tools we offer, including the AI image editor, AI photo filters, AI image generator, and other background tools such as the background remover, background changer, and background blurrer ("Service"). PicTools.AI is operated by Dice la cancion, S.L. ("Company", "we", "our").

Our Privacy Policy also applies to your use of the Service. It explains how we collect, protect, and handle your information.

By using our Service, you agree to these Terms and our Privacy Policy. If you don't agree, please don't use the Service. These Terms apply to everyone who visits or uses PicTools.AI.

2. Communications

When you create an account, we may send you updates, tips, and occasional newsletters. You can unsubscribe anytime by clicking the link in any email or emailing us at contact@pictools.ai. We'll still send important messages about your account and payments.

3. Purchases

When you buy credits or a subscription, you'll need to provide payment information. By purchasing, you confirm that you're authorized to use the payment method and that your billing info is accurate.

We use Stripe to process payments securely. We may cancel orders if there's a problem with availability, pricing errors, or suspected fraud.

4. Subscriptions

Some features require a subscription. You'll be billed at the start of each billing cycle (monthly or annual, depending on your plan).

Your subscription renews automatically unless you cancel. You can cancel anytime from your account settings.

If a payment fails, we'll send you an invoice to complete manually.

5. Fee Changes

We may change subscription prices from time to time. If we do, we'll let you know in advance so you can cancel before the new price kicks in. If you keep using the Service after a price change, that means you accept the new price.

6. Refunds

7. Content

When you use PicTools.AI, you provide input (like images or text prompts) and receive output (the images we generate for you). Together, these are your "Content."

You're responsible for your Content. Make sure it doesn't break any laws or violate these Terms. You confirm that you have the rights to any images you upload.

Ownership is simple: you keep your input, and you own your output. Use it however you want, including for commercial purposes.

We only process your Content to provide the Service. We don't use your images to train AI models. We don't share, publish, or display your Content publicly. Your images stay private and are only visible in your personal history.

We may terminate accounts that infringe copyrights or violate these Terms.

8. Prohibited Uses

Use PicTools.AI responsibly and legally. Here's what's not allowed:

• Anything that violates any applicable law or regulation.
• Exploiting, harming, or attempting to harm minors in any way.
• Generating, uploading, or distributing sexually explicit, pornographic, or NSFW content.
• Generating or spreading false information to harm others.
• Generating personal information that could be used to harm someone.
• Harassing, defaming, or threatening others.
• Making automated decisions that negatively affect someone's legal rights.
• Discriminating against individuals or groups based on personal characteristics, online behavior, or legally protected categories.
• Exploiting vulnerable groups based on age, social, physical, or mental characteristics.
• Providing medical advice or interpreting medical results.
• Generating content for law enforcement, immigration, or justice system decisions.
• Impersonating PicTools.AI, our team, other users, or any person or entity.
• Any illegal, fraudulent, threatening, or harmful activity.
• Restricting or interfering with anyone else's use of the Service.

You also agree not to:

• Overload, damage, or interfere with the Service.
• Use bots, scrapers, or automated tools to access the Service without permission.
• Introduce viruses, malware, or other harmful code.
• Attempt to hack or gain unauthorized access to any part of the Service.
• Attack the Service with denial-of-service or similar attacks.
• Damage or manipulate our ratings or reputation.
• Interfere with the proper functioning of PicTools.AI.

9. Intellectual Property

PicTools.AI, including our tools, design, and branding, belongs to us. You can't use our trademarks or branding without permission. But remember: the images you create are yours.

10. Limitation of Liability

AI isn't perfect, and sometimes results may not meet your expectations. Here's the legal part:

You agree to hold the Company and its directors, employees, and agents harmless for any indirect, punitive, special, incidental, or consequential damages arising from your use of the Service, including legal fees and costs, whether from contract, negligence, or other claims — even if we've been warned about the possibility of such damages.

If we are found liable, our responsibility is limited to the greater of: (a) what you paid us in the 12 months before the issue arose, or (b) $100. We are not responsible for consequential or punitive damages.

11. Termination

We can suspend or close your account if you break these Terms. If you want to leave, just stop using PicTools.AI. Some parts of these Terms (like liability limits and ownership) still apply after termination.

12. Governing Law

These Terms are governed by applicable law. If there's a dispute, we'll try to work it out directly first. If we can't resolve it, we'll use binding arbitration conducted in English.

If we don't enforce a part of these Terms, that doesn't mean we waive our rights. If any part of these Terms is found invalid, the rest still applies. These Terms are the complete agreement between you and PicTools.AI.

13. Changes to Service

We may update, change, or temporarily disable parts of PicTools.AI without notice. We're not responsible if the Service is unavailable at any time.

14. Changes to These Terms

We may update these Terms from time to time. If we do, we'll post the new version here. By continuing to use PicTools.AI after changes are posted, you agree to the updated Terms.
